The law can be confusing because it makes a big distinction between motorized bicycles, or mopeds, and scooters. Mopeds have a top speed of less than 25 mph, while scooters can go faster. State law treats mopeds much like bicycles - no license plates or insurance needed, and driver's licenses are not required. However, unlike bicyclists, moped operators must be at least 15, and those younger than 19 must wear helmets and eye protection.
Scooters go faster than 25 mph and are rightly treated as motorcycles, requiring license plates and insurance. Operators must have a driver's license with motorcycle endorsement or motorcycle learner's permit.
One result of the moped/scooter difference: Drivers whose licenses have been suspended can legally operate a moped, but on a scooter, they are driving while suspended.
Deputy Police Chief Marty Bender says larger, responsible scooter dealers inform buyers of the laws, but smaller dealers sometimes misinform buyers.
City police announced a two-week grace period during which they will give illegal scooter operators warnings before they begin writing tickets
Double Eastside Traffic Fatality

Two people were killed in a crash on the eastside at 38th Street and Lesley Avenue early Sunday morning.
IMPD Sergeant Matthew Mount says a 22 year old man from Indianapolis and a boy toddler were thrown from their eastbound car after contact with a southbound black pickup truck near Lesley Avenue.
Their car went out of control, flipping over and violently ejecting both of them over a single story building. The toddler also hit a man on a moped before landing on the pavement. The driver of the car died at the scene while the toddler was pronounced dead at the hospital.
The names of the victims have not been released. Police are still looking for the driver of the black pickup truck.
